Notice of Proposed Action

[18-339-P]

The Secretary of Health proposes to amend:

(1) Regulations .06—.08 under COMAR 10.22.17 Fee Payment System for Licensed Residential and Day Programs; and

(2) Regulation .04 under COMAR 10.22.18 Community Supported Living Arrangements Payment System.

Statement of Purpose

The purpose of this action is to establish in the regulations the FY19 reimbursement rates for Licensed Residential and Day Programs and Personal Support services as part of Community Supported Living Arrangements (CSLA) services in accordance with Health-General Article, §7-307(d), Annotated Code of Maryland.

Comparison to Federal Standards

There is no corresponding federal standard to this proposed action.

Estimate of Economic Impact

I. Summary of Economic Impact. The proposed action increases the rate paid to providers. The proposed action includes a 3.5 percent COLA for providers. The total impact of this increase for the agency and the regulated industry equals $39,116,904.

A. A 3.5 percent increase in rates will cause the expenditures of the Developmental Disabilities Administration (DDA) for community services to increase by an estimated $39,116,904 in total funds. The total general funds impact of these changes is $20,523,282.

D. Regulated provider agencies will benefit from increases to rates by an estimated $39,116,904 in total funds ($20,523,282 in general funds).

Economic Impact on Small Businesses

The proposed action has a meaningful economic impact on small business. An analysis of this economic impact follows.

The proposed action has a meaningful economic impact on small businesses because the higher reimbursement rates infuse dollars into provider agency entities that provide these services in the community.

Impact on Individuals with Disabilities

The proposed action has no impact on individuals with disabilities.

(2) Effective July 1, [2017] 2018, the amount per unit of service for residential programs is as follows:

(a) In Baltimore City and Allegany, Anne Arundel, Baltimore, Caroline, Carroll, Dorchester, Garrett, Harford, Howard, Kent, Queen Anne’s, St. Mary’s, Somerset, Talbot, Washington, Wicomico, and Worcester counties — [$19.78] $20.47;

(b) In Cecil County — [$20.82] $21.55; and

(c) In Calvert, Charles, Frederick, Montgomery, and Prince George’s counties — [$21.09] $21.82.

(3) Effective July 1, [2017] 2018, the amount per unit of service for day habilitation and community learning services is as follows:

(a) In Baltimore City and Allegany, Anne Arundel, Baltimore, Caroline, Carroll, Dorchester, Garrett, Harford, Howard, Kent, Queen Anne’s, St. Mary’s, Somerset, Talbot, Washington, Wicomico, and Worcester counties — [$22.11] $22.88;

(b) In Cecil County — [$23.16] $23.96; and

(c) In Calvert, Charles, Frederick, Montgomery, and Prince George’s counties — [$23.43] $24.24.

(4) Effective July 1, [2017] 2018, the amount per unit of service for supported employment and employment discovery and customization is as follows:
