Title 10
MARYLAND DEPARTMENT OF HEALTH
Subtitle 34 BOARD OF PHARMACY
10.34.09 Fees
Authority: Health Occupations Article, §12-205, Annotated Code of Maryland
Notice of Proposed Action
[18-346-P]
The Secretary of Health proposes to amend Regulation .02 under COMAR 10.34.09 Fees. This action was considered by the Board of Pharmacy at an open meeting held on July 18, 2018, notice of which was given by publication on the Board of Pharmacy website, http://health.maryland.gov/pharmacy/Pages/index.aspx, from July 13—18, 2018.
Statement of Purpose
The purpose of this action is to eliminate an administrative fee when the Board of Pharmacy reviews a pharmacy technician training program that includes a didactic portion that is identical to a program which the Board of Pharmacy has previously approved. The fee is not necessary because no additional administrative resources are expended by the Board of Pharmacy.
Comparison to Federal Standards
There is no corresponding federal standard to this proposed action.
Estimate of Economic Impact
I. Summary of Economic Impact. Based on data from Fiscal Year 2018, the potential loss of fees to the Board, and the corresponding benefit to licensees, as a result of this change is not likely to exceed $300.

III. Assumptions. (Identified by Impact Letter and Number from Section II.) |
A. and D. The economic impact would be approximately $300 loss in fees to the Board and a benefit to the licensees in the same amount. This assumption is based on the fact that only two programs in the past year might have been affected by this change. (2 x $100 = $200). The calculation of a potential $300 impact allows for a variance of one additional fee. |
Economic Impact on Small Businesses
The proposed action has minimal or no economic impact on small businesses.
Impact on Individuals with Disabilities
The proposed action has no impact on individuals with disabilities.
